The Environmental Qualities and Characteristics of Products (QCE) art.13 AGEC law

📖 Who is concerned?


All producers are concerned:

  • Importers

  • Stakeholders

  • Distributors

  • Or other entities placing new products on the market that generate waste intended for consumers.

🔄Who is subject to the display obligation


📅 Display obligation as of January 1, 2025 if:

  • Annual turnover across all relevant sectors > €10M

  • > 10,000 units placed on the market annually across all relevant sectors

These conditions apply taking into account the cumulative products subject to Extended Producer Responsibility sectors placed on the French market annually during the last fiscal year.

What are the mandatory display methods for the QCE?

The information must be provided electronically in the form of a "product sheet", accessible at the time of purchase, free of charge, and available on a dedicated website or webpage. The title of the site, page, or section of the page must be "product sheet related to environmental qualities or characteristics," supplemented by the name and reference of the model concerned.

Presence of hazardous substances


The obligation to display information on the presence of a hazardous substance applies when it is present in concentrations greater than 0.1% by mass in a substance, mixture, or article, as defined in points 1, 2, and 3 of Article 3 of Regulation (EC) No 1907/2006, known as "REACH." 

Information regarding hazardous substances can be displayed through:

  • The product sheet 

  • The Scan4Chem application. This is funded by the European Commission under the LIFE program, in which France actively participates through the National Institute for Industrial Environment and Risks (INERIS).

The information to be displayed is as follows: “Contains a hazardous substance” or “Contains a substance of very high concern.” The information is supplemented with the name of each hazardous substance present.

Recyclability


For a product to be considered recyclable, it must meet five cumulative conditions, according to Decree No 2022-748 of April 29, 2022.

📝 Definition

AGEC recyclability: 5 cumulative conditions

  1. Ability to be collected

  2. Ability to be sorted

  3. Absence of disruptors

  4. Majority composition in recyclable materials

  5. Capacity and durability of disposal avenues

If these conditions are met, you are required to display one of the following mentions:

  • «entirely recyclable product»: mention reserved for products that can be recycled more than 95%.

  • «majority recyclable product»: mention reserved for products that can be recycled more than 50%.

  • «recyclable product into a product of the same nature»: mention reserved for products that can be recycled at least 50% within a product from the same EPR sector (closed-loop).

What to do if the product is not recyclable?

« Negative mentions are not required. In this case, the producer or importer should not display anything in the product sheet. »
