Regulatory Focus:

  • Spare parts replaced or used during a legal warranty period are not subject to eco-participation. This exemption is explained because eco-participation applies only to the sale of new products placed on the market, and not to after-sales operations covered by a warranty.

  • New Spare Part: New spare parts or so-called "original" parts, when sold outside the warranty framework (e.g., out-of-warranty repair, in-store or online sales to individuals), are subject to eco-participation. The applicable amount follows the standard coding in force, according to the product reference.

  • Parts from the circular economy (used or refurbished): Used or reused/refurbished spare parts are not subject to eco-participation when sold or reused.

  • Definitions:

    • Spare Part: Integral part of a product, essential for the primary functioning of the item. The replacement part may differ in aesthetics from the original part, provided functionality and regulatory compliance are respected.

    • Original Part: Specifically manufactured according to the manufacturer's specifications, ensuring compatibility and quality.

    • Used Part: Sourced from the secondary market, not necessarily subject to prior inspection. Example channels: flea markets, classified ad platforms, specialized reuse actors.

    • Reused Part / PIEC (Parts from the Circular Economy): Previously used on a piece of furniture, it has been recovered for a second life or refurbishment.

Any new or original spare part sold as a new product, outside the warranty context, must be coded and displayed in accordance with eco-participation rules (product code, amount, and display on commercial media).
