This system is essential for ensuring compliance for market players, distributors, and operators, while supporting the circular economy strategy and responsible waste management.
This guide helps anticipate changes, avoid sanctions, and optimize the operational management of EPR (Extended Producer Responsibility) obligations, making it easier to access key information and practical tools.
📌 Objective
The main objective is to ensure regulatory compliance for members by providing the necessary guidelines to:

🏗 1. REP Building News
The Minister responsible for ecological transition, Agnès Pannier-Runacher, has initiated a reform of the REP Building sector, including a moratorium on certain provisions planned for 2025 and 2026.
National consultations are being organized to adapt the deployment to the sector's specifics.

📝 2. Solutions to comply with the AGEC law
1. Displaying eco-participation for the furniture sector
Mandatory display for sales to professionals and individuals (Article R543-247 of the Environmental Code).
Eco-participation must be passed on identically throughout the supply chain.
Administrative fine for failure to display (Article L541-9-4).

2. Unique identifier
Registration of market players with ADEME and transmission of data related to the unique identifier via Ecomaison.
Mandatory display of the unique identifier for each sector in the GTC or other contractual documents, including on websites.
Publication of the list of registered entities and their identifiers by ADEME
3. TRIMAN sorting signage
Mandatory on packaging, products, or accompanying documents.
Exceptions for small products (surface < 10 cm² or 20 cm² for cylindrical/spherical products).
Fine up to €15,000 for missing signage.
4. Obligation to collect used products
Analysis by dedicated sales area for each sector.
Collection 1 for 1 or 1 for 0 depending on the area and turnover.
For the building sector: free collection for areas > 4,000 m².
Mandatory visible and accessible consumer information (Article R541-163).
Consumers must be clearly informed, before purchase, of collection methods in stores, whether in-boutique or when selling remotely.
5. Repair Fund (furniture, DIY and gardening sectors)
Mandatory to inform clients about the existence of a Repair Fund in a visible, legible, and easily accessible way regarding repairability options starting from July 1, 2024.

6. Ban on disposal of unsold non-food items
Principle of donating unsold items from distributors to reuse or solidarity associations.
Ecomaison intervenes after three different associations refuse the items, provided the product’s eco-participation fee has been paid.
🌱 3. Eco-design Obligations
Displaying environmental characteristics
AGEC law (art. 13): obligation to inform consumers about the environmental qualities of products (marking, labeling, displaying, etc.).
Prohibition of terms such as “biodegradable,” “environmentally friendly,” and equivalents.
Mandatory display on a dedicated online product sheet, including display of eco-participation bonuses and penalties.
