The collection and reuse of end-of-life products are central obligations of the REP sector. Ecomaison organizes and coordinates these processes to ensure regulatory compliance, reduce waste, and promote the circular economy. This sheet specifies the roles of manufacturers and stakeholders in the chain, as well as the practical modalities of implementation.

  • Collection must be easily accessible to consumers via drop-off points or in-store returns.

  • Reuse takes priority over recycling and should be encouraged by manufacturers and collectors.

  • Traceability of collected and reused flows is mandatory and reported to Ecomaison.

📚 Important Details to Know


  • Collection organization: Ecomaison mobilizes a network of approved operators (collectors, recycling centers, resource centers) to ensure the recovery and sorting of products.

  • Reuse modalities: Products in reusable condition are directed to reuse structures and social and solidarity economy actors ESS (associations, resource centers, etc.).

  • Regulatory obligation: Manufacturers must ensure the implementation and financing of collection and reuse systems, in accordance with legal requirements.

For pickup sales:

*For textile decoration elements: take-back obligations under the same framework as the other 11 product categories since January 1, 2023

For pickup sales:

  • for products whose external dimensions are less than 160 cm AND

  • whose transportation does not require equipment

For pickup sales:
Area > 1000 m²:

In cases where a store sells products from multiple categories, for example:

  • furniture,

  • toys

  • DIY items,

analysis by dedicated sales area must be performed separately for each relevant product category.

For Third-Party Sellers

An obligation applies as soon as their annual turnover of products subject to REP in delivery exceeds €100,000. They must organize free take-back of an equivalent product and inform the marketplace of the take-back conditions.

In case of non-compliance by the third-party seller, the take-back obligations fall to the marketplace, which then becomes responsible.

For Marketplaces

The platform informs clients about the possibility of free take-back and specifies the conditions set by the third-party seller. Regarding the Furniture, Toys, DIY, and Garden categories, there is an obligation to take back used products under the aegis of Ecomaison. If the third-party seller fails to meet this obligation, the marketplace assumes responsibility for organizing the take-back.

Take-Back Rules in Case of Delivery

  • For all sectors (furniture, DIY, garden, toys), a "one-for-one" rule applies: free take-back of an equivalent product upon the purchase of a new product when the annual turnover reaches €100,000 excluding tax or more.

  • The Pro Card implemented by Ecomaison offers a solution for these items with free access to more than 2,500 bins.

  • A bin can also be installed in a delivery warehouse if the acquisition conditions are met.

When sales are made with delivery, the take-back of used products occurs at the delivery point, or at a nearby collection point that the distributor finances and organizes or has organized when it involves products transportable without equipment*, or by providing a free return solution for the owner such as a postal service or equivalent when the characteristics of the used products allow.

*Transportable products without equipment = < 2m < 20kg

  • A distributor ensures the free take-back of an old piece of furniture during the delivery of a new one; the furniture is inspected and directed to a network of resource centers if reusable.

  • A consumer drops off used furniture at a recycling center where it is sorted: reusable elements are redirected to local reuse partners.

  • Traceability and annual reporting of collected and reused volumes to be provided to Ecomaison.


Obligation to Inform the Consumer


  • Obligation to inform customers before the conclusion of any sale, online or physical, about the conditions for taking back used products.

  • Class 5 sanctions, up to €1,500 in fines, are provided in case of failure to inform or organize the take-back.

  • In-store: visibly display this information in the aisles.

📢 Producer Obligations


  • Ensure the implementation and funding of collection and reuse systems.

  • Collaborate with approved stakeholders and ensure the traceability of end-of-life products.

  • Promote reuse before any recycling or disposal operation.

  • Inform the consumer before the purchase about the conditions of product take-back.

  • Regular inspections are organized by the DGCCRF, which can result in fines.

🗑 How to manage my unsold products?

🗣Answer: 

The AGEC law of February 10, 2020 specifies that, as of January 1, 2022, it is prohibited for persons holding unsold products to dispose of their unsold non-food items.

These items are understood in this article as any "new non-food product intended for sale." In case of failure to comply with this obligation, a fine of up to €15,000 may be imposed on legal entities.

This obligation applies to products already subject to REP (as of February 10, 2020), including furniture components as of January 1, 2022, before extending to all products for sale no later than December 31, 2023.

To comply with this obligation, persons holding unsold products are required to donate their unsold items to a reuse or solidarity actor. Failing that, if no reuse solution is found after three unsuccessful attempts, persons holding unsold products can transfer them to the eco-organization concerned with these products, provided that the eco-contribution for these products has been paid to the organization.

📦 What is an unsold item?

Any product placed on the market and which has not found a buyer is considered unsold. As of January 1, 2022, it will be prohibited to dispose of non-food unsold items under penalty of fines. They must be offered to solidarity associations.
